NSW AI Assessment Framework and platform transition

Instrument

NSW AI Assessment Framework (Digital NSW), used with NSW AI operational policy and assurance expectations for public sector AI use.

Type and status

Government guidance for NSW agencies. This briefing describes policy and framework requirements as published by Digital NSW. It is not legal advice and does not create obligations for organisations outside NSW government.

Applicability and dates

The framework applies to NSW public sector AI governance and assurance processes. Digital NSW indicates that new registrations and assessments are to be completed through the assessment platform from 30 September 2026. Confirm current wording, scope and any exemptions on the primary source before relying on dates in procurement or assurance planning.

Practical institutional implications

Registration and impact assessment are administrative entry points. For consequential work, institutions still need clarity on:

  • who is accountable for the use case and its outcomes;
  • what evidence supports admission, operation and review;
  • where human judgement is required before action is taken;
  • how AI contribution is distinguished from facts the institution has established;
  • how escalation, pause and refusal operate when risk or context changes.

A completed assessment form does not by itself demonstrate that authority, evidence and accountability remain intact through real work.

DataMPowered interpretation

DataMPowered treats NSW registration and assessment as necessary governance infrastructure, complementary to assurance of AI-supported institutional work: whether the work itself remains legitimate, authorised and accountable when AI contributes. That distinction is separate from model-only assurance. ifCEM may support guided evaluation and bounded organisational pilots where institutions want to demonstrate how governance could operate in practice; it is not NSW-endorsed and does not satisfy assessment obligations automatically.
